JUNGLEKEEPERS SWEEPSTAKES OFFICIAL RULES
(THE “RULES”)
1. Sponsor and Administrator. The Heart Of the River Sweepstakes (the “Sweepstakes”) is sponsored and administered by Junglekeepers Incorporated, a charitable not-for-profit corporation organized and existing under the laws of the State of New York, having an address at 428 Haperman Hill Road, Red Hook, NY 12571 (“Junglekeepers”).
2. NO DONATION NECESSARY. You are not required to make a donation to Junglekeepers to enter or to win the Sweepstakes. A donation will not increase your chances of winning.
3. Eligibility. These Sweepstakes is open to natural persons who are legal residents of the 50 States of the United States of America, the District of Columbia, and Puerto Rico (the “Eligible Territories”), who are 18 years of age or older, or the age of majority in their place of residence (19 in Alabama and Nebraska, 21 in Mississippi, and 18 in all other states) as of the date of entry into the Sweepstakes (the “Entrant”). The Sweepstakes is void outside the Eligible Territories, and anywhere else where prohibited, taxed or restricted by law. Officers, directors, managers, and employees of Junglekeepers, its affiliated and related organizations, its vendors and consultants, and each of their immediate family members (parents, children and siblings, whether or not related by blood, as well as spouses, and siblings-in-law) and those living in their household, are not eligible to participate in the Sweepstakes. The Sweepstakes may only be entered in or from the Permitted Territories, and entries originating from any other jurisdiction are not eligible for entry into the Sweepstakes. All federal, state and local laws and regulations apply.
4. Entry Limits. A maximum of 1,000 entries into the Sweepstakes (each, an “Entry”) per Entrant (the “Entry Limit”) is permitted. All Entries exceeding the Entry Limit are void. Any attempt by an Entrant to obtain more Entries than the Entry Limit by using multiple or different identities, or otherwise circumvent the Entry Limit, will void those Entries and Entrant may also be disqualified from the Sweepstakes. Entries submitted by anyone other than Entrant are void. ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CIVIL AND CRIMINAL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, JUNGLEKEEPERS RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. JUNGLEKEEPER’S FAILURE TO ENFORCE ANY TERM OF THESE RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS.
5. Drawing and Odds. On or about 31 December 2024 (the “Drawing Date”), potential prize winners will be selected in a random drawing from all eligible Entries received by Junglekeepers. Odds of winning depend on the number of eligible Entries received. By entering the Sweepstakes, Entrants, potential prize winners and prize winners (collectively, “Participants”) fully and unconditionally agree to be bound by these Rules and the decisions of Junglekeepers, which will be final and binding in all matters arising out of or relating to the Sweepstakes.
6. Correct Information Necessary. In case of a dispute as to the identity of an Entrant, the Entry will be declared made by the registered name, and mailing and email addresses, on the Entry. To be eligible to receive a prize, an Entrant must provide mailing and email addresses, when prompted, at the time of entry into the Sweepstakes. In the event that an Entrant has provided any false or incomplete address, or a mailing address outside the Eligible Territories, the Entrant will be disqualified and an alternate prize winner will be selected in a random drawing. Any potential prize winner may be requested to provide Junglekeepers with proof that such person is the prize winner, and any person that is unable to provide such proof may be disqualified.
7.
How to Enter. There are two (2) ways to enter the Sweepstakes:
7.1. Donation. To enter by making a donation, you may make an online donation of at least $5.00, to Junglekeepers, through the Junglekeepers donation website located at https://www.junglekeepers.org/donate. Each $5.00 donated is considered to one Entry. All currency stated in these rules are in United States Dollars.
7.2. Form Submission. To enter without making a donation, you may submit the entry form through the Junglekeepers Sweepstakes entry form located at https://www.junglekeepers.org/donor/sweetstakes-2024. Each complete submission is considered one Entry.
Entrants may use either or both methods to enter the Sweepstakes, but total Entries may not exceed the Entry Limit. Regardless of the method of Entry, all Entries must be submitted no later than 11:59:59 Eastern Time on 24 December 2024. Use of automated systems to submit Entries is prohibited, and Entrants who use such systems will be disqualified from the Sweepstakes. Junglekeepers is not responsible for any Entry that is incomplete or invalid, whether due to system errors, omissions, interruption, deletions, defects, delay in operations or transmissions, theft or destruction or failures, faulty transmissions or other telecommunications malfunctions, human error, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise. Only fully completed Entries are eligible. Proof of submission of an Entry will not be deemed to be proof of receipt by Junglekeepers.
8.
Prizes. Prize values are in United States dollars. The following are the number and type of prizes available in the Sweepstakes.
8.1. Grand Prize. One (1) grand prize, valued at $15,000 will be awarded, consisting of a five-day trip for 2 people to visit Junglekeepers in Peru. The grand prize is limited to round-trip economy class airplane tickets, 5 days meals and lodging, and round-trip local travel between the place of lodging and Junglekeepers premises, for 2 people. Junglekeepers reserves the right to determine, in its sole discretion, the airline used, the location and type of meals served, the place lodged, and the local travel provided. As a condition for award of the grand prize, the 2 people who will visit Peru must execute a liability waiver and publicity release, in the form provided by Junglekeepers. In the event that the 2 people are unwilling or unable to execute said waiver and release, the grand prize winner will be disqualified from the Sweepstakes, and an alternate grand prize winner will be selected in a random drawing. The value of the grand prize is taxable as income, and the grand prize winner is solely responsible for any taxes, including, without limitation, all federal, state and local taxes that become due with respect to the value of the prize. Junglekeepers must report the value of the prize to the Internal Revenue Service in the year that the prize is received, and will be so reported in a Form 1099.
8.2. First Prizes. Five (5) first prizes will be awarded, each consisting of a Junglekeepers River Shirt which is valued a $150.
8.3. Second Prizes. Ten (10) second prizes, will be awarded, each consisting of a Junglekeepers T-Shirt which is valued at $40.
8.4. Third Prize. One (1) third prize will be awarded, consisting of a one-on-one video chat with Paul Rosolie.
9. Prize Restrictions and Conditions. Each Entrant and each household of Entrant is limited to one prize, regardless of the number of Entries. All prizes are non-transferable and non-assignable. No prize may be substituted or redeemed for cash. Junglekeepers will not replace any lost or stolen prizes. In the case of unavailability of any prize, Junglekeepers reserves the right to substitute a prize of equal or greater value. Each prize winner is solely responsible for all applicable federal, state and local taxes, arising out of or related to the prize, including taxes imposed on such winner’s income. No more than the stated number of prizes set forth in these Rules will be awarded. PRIZES ARE AWARDED “AS-IS,” “WHERE IS,” WITH ALL FAULTS AND WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTBILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND ALL WARRANTIES ARISING FROM ANY COURSE OF DEALING OR PERFORMANCE OR USAGE OF TRADE. JUNGLEKEEPERS EXPRESSLY DISCLAIMS ANY AND ALL SUCH WARRANTIES.
10. Notification and Claim. Potential prize winners will be notified by Junglekeepers by email on or about January 10th, 2025. Winners must respond to the notification within 5 business days of the notification. In the event that a potential prize winner does not respond to the notification within 5 business days, or if Junglekeepers determines, in its sole discretion, that a potential prize winner is not eligible in accordance with these Rules, an alternate prize winner will be selected at random amongst the remaining non-winning eligible Entries. The potential grand prize winner will be required to sign and return (except where prohibited) an affidavit of eligibility, the names and ages of the 2 people who will be part of the trip and a W-9 tax form (the “Documents”) within 10 business days of the notification. Additionally, if a potential grand prize winner is considered a minor in their jurisdiction of residence, the Documents must be completed and signed by their parent or legal guardian and such grand prize will be awarded in the name of the parent or legal guardian and not the minor. If the potential grand prize winner does not return the Documents within the 10 business day period, is found to be ineligible, or does not comply with these Rules, the potential grand prize winner and their Entry will be disqualified, and another potential grand prize winner will be selected from the remaining eligible Entries received. The 2 people who will be part of the trip, named in the Documents, will be required to execute a liability waiver and publicity release (the “Releases”), within 15 business days of the notification. If a person who will be part of the trip is considered a minor in their jurisdiction of residence, the Releases must be completed and signed by their parent or legal guardian. If both people who will be part of the trip do not return the Releases within the 15 business day period, the potential grand prize winner who named the 2 people, and their Entry, will be disqualified, and another potential grand prize winner will be selected from the remaining eligible Entries received. No compensation will be provided for any prizes that are not able to be awarded to a potential prize winner or prize winner.
11. Release of Liability. By participating in these Sweepstakes, Participants release Junglekeepers and its affiliated entities, and their respective officers, directors, employees, representatives and agents (collectively, the “Released Parties”) from any and all liability, damages or causes of action (however named or described) arising out of or relating to the participation in the Sweepstakes, or the receipt or use or misuse of any prize awarded, including, without limitation, liability for personal injury, death or property damage. Failure to comply with these Rules may result in disqualification from the Sweepstakes.
12. Indemnification. By participating, Participants agree to release, discharge, indemnify and hold harmless the Released Parties from and against any claims made by any Participant, or any other third parties, related in any way to the operation of these Sweepstakes, as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from receipt, acceptance, possession, misuse or use of a prize or participation or participation in these Sweepstakes.
13. Publicity. Potential prize winners and prize winners consent to the use of their name, likeness, voice, biographical information and location (city and state) for Junglekeepers’ promotional, advertising and publicity purposes, worldwide, in any media, without additional payment, consideration and compensation, to the fullest extent not prohibited by state law.
14. General Conditions. The Sweepstakes is conducted in the English language. Any discrepancy or inconsistency between the terms and conditions of these Rules, in the English language, and any other statements contained in any Sweepstakes-related material, including, without limitation, any entry form, solicitation or advertising, the terms and conditions of these Rules, in the English language, shall prevail, govern and control. All federal, state and local taxes are solely the responsibility of prize winners. By participating in these Sweepstakes, Participants agree to be bound by these Rules and the decisions of Junglekeepers, which are final in all respects and not subject to appeal. Junglekeepers reserves the right to permanently disqualify from the Sweepstakes any Entrant it believes has violated these Rules, and verify eligibility of Entrants. In the event any portion of these Sweepstakes is compromised by activities beyond the control of the Junglekeepers which, in the sole opinion of the Junglekeepers, corrupt or impair the administration, security, fairness or proper play of the Sweepstakes or these Sweepstakes, Junglekeepers reserves the right at its sole discretion to modify, suspend or terminate the Sweepstakes. All Sweepstakes materials are subject to verification and are void if (a) not obtained in accordance with these Rules and through legitimate channels, (b) any part is counterfeited, altered, defective, damaged, illegible, reproduced, tampered with, mutilated or irregular in any way, (c) are obtained where prohibited, or (d) they contain printing, typographical, mechanical, or other errors. Participants assume all risk of loss, damage, destruction, delay or misdirection of Sweepstakes materials submitted to Junglekeepers.
15. Limited Liability. The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by a Participant, by printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (b) technical failures of any kind, including, but not limited, to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any aspect of the Sweepstakes; (d) printing, typographical, technical, computer, network or human error which may occur in the announcement of the prizes or in any Sweepstakes-related matter or materials; or (e) any injury or damage to a Participant or to other persons or property which may be caused from an their participation in the Sweepstakes or their downloading of any materials related to these Sweepstakes. If for any reason an Entrant’s Entry is confirmed to have been erroneously lost, or otherwise destroyed or corrupted, the Entrant’s sole remedy is another Entry in the Sweepstakes.
16. Dispute Resolution. These Rules shall be construed and enforced in accordance with the laws of the State of New York, United States of America (“New York”), excluding its choice-of-law principles, and any dispute, controversy or claim, arising out of or relating to these Rules, the Sweepstakes or any prizes awarded, whether sounding in contract, tort or otherwise (hereinafter “Dispute”), shall likewise be governed by the laws of said State, excluding its choice-of-law principles. By participating in these Sweepstakes, Participants agree with Junglekeepers to use good faith efforts to settle amicably, privately and confidentially, any Dispute. Any Dispute not amicably settled shall be subject to arbitration. Arbitration shall be held in New York, with one (1) arbitrator, in the English language. Arbitration shall be conducted in accordance with the Expedited Procedures of the Commercial Arbitration Rules of the American Arbitration Association. The American Arbitration Association shall serve as appointing authority if the parties to the arbitration are unable to agree upon the composition of the arbitral tribunal. The arbitral tribunal shall have no power or authority render decisions ex aequo et bono, to sit as amiable compositeur, to award exemplary, punitive, incidental, consequential or other speculative damages, to award attorneys’ fees, or to award interest in excess of the Wall Street Journal Prime Rate then prevailing or any interest other than simple interest. The award shall be the final adjudication of any dispute, controversy or claim, and may be entered as a final and unappealable judgment in any court of competent jurisdiction. To the extent arbitration of a Dispute is prohibited under applicable law, Participants and Junglekeepers IRREVOCABLY CONSENT to the exclusive jurisdiction of the state and federal courts sitting in New York, and, to the fullest extent permissible under applicable law, IRREVOCABLY WAIVE any objection based on such courts being inconvenient forums and any right to trial by jury. Participants and Junglekeepers agree to resolve any Dispute on an individual basis only, and, to the fullest extent not prohibited by applicable law, IRREVOCABLY WAIVE any right to assert any claims in connection with a Dispute on a class, representative or collective action basis.
17. Personally Identifiable Information. Information collected from Entrants is subject to Junglekeepers’ Privacy Policy (https://www.junglekeepers.org/privacy_policy). By participating in the Sweepstakes, Participants hereby agree to Junglekeepers’ collection and usage of their personal information and acknowledge that they have read and accepted Junglekeepers’ Privacy Policy.
18. Winner List. For an official copy of these Rules or a winner list, send a self-addressed stamped envelope with proper postage affixed to Junglekeepers, 21701 Stevens Creek Blvd Unit 1753, Cupertino, CA 95015 USA. Rules will be made available for 30 days following the end of the Sweepstakes.
